01Agreement

These Terms of Service ("Terms") govern your use of nm9performance.com, the NM9 Student-Athlete Club membership, and all content, programs, books, journals, downloads, events and community spaces offered by NM9 Performance LLC ("NM9," "we," "us"). By creating an account, buying a membership or using the site, you agree to these Terms. If you do not agree, please do not use the site.

02Who can join

NM9 serves student-athletes and their families. Memberships must be purchased and managed by an adult who is at least 18 years old. If the athlete is under 18, the parent or legal guardian who buys the membership is the account holder, accepts these Terms on the athlete's behalf, and is responsible for supervising the athlete's use of the program and community. Before an athlete joins the member community, the parent or guardian signs the NM9 Parent Agreement.

03Memberships and billing

The NM9 Student-Athlete Club is offered in tiers (currently Rookie, Starter and Elite) on monthly or annual plans. Prices and what is included in each tier are shown on our membership page at the time you buy. Payments are processed securely by Stripe; we never see or store your full card number.

• Automatic renewal. Memberships renew automatically at the end of each billing period (monthly or yearly) and your payment method is charged the then-current price until you cancel.
• Price changes. If a price changes, we will notify you before it applies to your next renewal.
• Upgrades and downgrades. You can change tiers at any time; changes take effect as described at checkout or in your billing portal.

04Cancellation and refunds

You can cancel anytime. Cancellation stops future renewals, and you keep access through the end of the period you already paid for. Except where required by law, payments are non-refundable and we do not provide partial refunds for unused time. If you believe you were charged in error, contact us within 30 days and we will make it right.

05Health and safety

NM9 content covers training, nutrition, sleep, recovery, mindset and habits. It is educational and is not medical advice. Talk with a physician before starting any training, nutrition or supplement plan, especially for a minor. Athletes should train within their ability, under appropriate adult supervision, and stop if they feel pain or unwell. You participate voluntarily and accept the ordinary risks of athletic training.

06No guarantees

We share the standards and systems that helped Noah and others grow, but every athlete is different. NM9 does not guarantee any specific result, including playing time, rankings, offers, scholarships, recruiting outcomes or academic results. Recruiting guidance is educational and does not make NM9 a recruiter, agent or representative of any school or organization.

07Community standards

The NM9 community is built on Faith Over Fame. Members, parents and athletes agree to be respectful, encouraging and safe. We do not allow bullying, harassment, hate, sexual content, sharing other people's private information, spam or selling. Adults may not privately message minor members through NM9 spaces. We may remove content or suspend or end any membership that breaks these standards, without refund.

08Your content and media

If you post photos, videos, wins or testimonials in NM9 spaces or tag us (for example #NotBySight), you keep ownership, and you give NM9 permission to display and share that content to celebrate and promote the program. We will not use a minor's image in paid advertising without a parent's consent, and you can ask us to take down your content at any time.

09Our content

All NM9 videos, books, journals, trackers, playbooks, graphics, logos and the Faith Over Fame and Not By Sight marks belong to NM9 Performance LLC or its licensors. Your membership gives you a personal, non-transferable license for use by your own family. Please do not copy, resell, share logins or redistribute our materials. Team and group use requires a team license.

10Live sessions and events

Live huddles, Q&As, film reviews, camps and clinics may be scheduled, rescheduled or recorded. Recordings may be shared with members. In-person events may have their own registration terms and waivers.

11Third-party services

We use trusted services such as Stripe (payments), our website and email platform, video hosting, and Amazon (books and journals). Your use of those services is also governed by their terms. Links to other sites are provided for convenience.

12Limitation of liability

The site and programs are provided "as is." To the fullest extent permitted by law, NM9 Performance LLC is not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

13Governing law

These Terms are governed by the laws of the State of Washington. Any dispute will be handled in the state or federal courts located in Pierce County, Washington, unless the law where you live requires otherwise.

14Changes and contact

We may update these Terms as the program grows. When we make material changes we will update the date above and notify members by email. Questions? Use our contact form or reply to any NM9 email and our team will get back to you.
